Central Administrative Tribunal Rejects ‘Superficial’ Compliance in Pension Fixation Dispute

The Central Administrative Tribunal (Principal Bench, New Delhi) has directed the implementation of consequential Seventh Central Pay Commission benefits for pre-01.01.2006 retirees in Central Govt. SAG (S-29) Pensioners Association v. Union of India & Ors. rejecting what it described as a restrictive and “superficial” approach to compliance with earlier directions concerning pension parity.

The Hon’ble Tribunal held that benefits flowing from the 7th CPC formed an integral part of the consequential reliefs already granted and could not be denied at the implementation stage through a narrow interpretation of the applicable orders. Accordingly, the respondents were directed to extend the corresponding benefits to the applicants in accordance with the applicable Rules within two months.

The ruling carries significant implications for pension fixation disputes and reinforces the principle that implementation of judicial directions must be substantive and effective, rather than merely technical or procedural.
